Despite popular misperceptions, Title IX does
not require colleges and universities to spend the same amount of
money on men’s and women’s sports programs, nor does
it require institutions to have the same number of men and women
varsity athletes. To prove compliance with Title IX, colleges and
universities must meet only one of three criteria:
- The percentages of male and female athletes are substantially
proportionate to the percentages of male and female students enrolled;
- The institution has a history and continuing practice of
expanding athletic opportunities for the underrepresented sex,
be that male or female;
- The institution fully and effectively accommodates the interests
and abilities of the underrepresented sex.
